CODE OF CONDUCT

Mutual Respect


This online community is built on mutual respect – you may not agree with what someone has said but they do have a right to their views. Be sensitive to your differences and look for common ground. If you do disagree with what someone has said then make sure you address the issue and not the person.

Also, remember that users of this online community are also busy people – make sure that your postings are relevant and to the point.

Extremist views

This online community is not a place for extremist views. In this spirit we do not tolerate the advocating of violence or incitement of any kind.

Keep it clean

Please make sure that the language you use is appropriate to a public place. No foul language – and if you are not sure then leave it out.

We ask that you ensure that anything you post is also appropriate – no illegal material (and that includes copyrighted!).

Quality information and debate

Check your facts – we hope that users will take responsibility for making sure that what they say is true. If you get it wrong or do not know the answer then say so.

TERMS OF SERVICE

1. Acceptance


The Woodland Trust Online Community system is provided free of charge to you by the Woodland Trust (Charity) under these Terms of Service. By using the Woodland Trust Online Community system, you are agreeing to be bound by these Terms of Service and Code of Conduct.

These Terms of Service and Code of Conduct govern your use of the Woodland Trust Online Community system to enter the Woodland Trust Online Community whether you are a user, a subscriber or a visitor and govern all services provided to you by the Woodland Trust Online Community, including but not limited to, access to message boards and use of any e-mail system, personal profile pages, and other features such as web page services, provided from time to time.

If you do not agree to these Terms of Service and Code of Conduct, please do not enter the Woodland Trust Online Community, register as a user or subscribe for further information.

2. Amendments

We reserve the right to amend these Terms of Service and Code of Conduct from time to time without notice to you.
You will be able to access the Terms of Service and Code of Conduct throughout the Woodland Trust Online Community. Please check the Terms of Service and Code of Conduct periodically to determine whether a change has been made to them. Registered users and subscribers will be notified of any change by e-mail. If you do not agree to changes in the Terms of Service and Code of Conduct as they may occur, please terminate your registration with us immediately and discontinue your use of the Woodland Trust Online Community via the Woodland Trust Online Community system. Your continued use of the Woodland Trust Online Community will signify your acceptance of any change in the Terms of Service and Code of Conduct set out here or in the future.

3. Registration

When you register with us you are stating that you are over 16 years of age or are between 13 and 16 years of age with parental consent to use the service you are registering for. PLEASE NOTE that all minors are recommended to discuss these terms and conditions with their parents or legal guardian before they complete any registration process or provide us with any information about themselves. We do not recommend persons who are 13 years of age or younger to register with the Woodland Trust Online Community.
In return for allowing you to access the Woodland Trust Online Community and to benefit from our services, you agree that any information you provide to us about yourself upon registration or at any other time will be true, accurate and complete and that you will ensure that this information is kept accurate and up to date at all times.

4. Password and Security

When you register to use the Woodland Trust Online Community via the Woodland Trust Online Community system your e-mail address will be allocated as your user name and you will be asked to create a password. You must keep this password confidential and must not disclose it to or share it with anyone. PLEASE NOTE that you will be responsible for all activities that occur under your password. If you know or suspect that someone else knows your password you should notify us immediately at websitemanager@woodland-trust.org.uk

If you forget your password a link on the register page can be used to enter your email address and your password will be sent to you, alternatively please contact us at websitemanager@woodland-trust.org.uk and we will be able to remind you of your password once you have satisfied our security check.

5. Privacy Policy

We treat your privacy very seriously and we understand that you will wish to know how we will use the information we collect from you. All use of your personal information will be in accordance with our Privacy Policy and will comply with all applicable UK data protection legislation, please click here to view our Privacy Policy.

The Privacy Policy is liable to change from time to time as appropriate to comply with the UK data protection legislation in force at the time. Registered users and subscribers will be notified of any change by e-mail. If you do not agree to changes in the Privacy Policy as they may occur, please terminate your registration with us immediately and discontinue your use of the Woodland Trust Online Community. Your continued use of the Woodland Trust Online Community via the Woodland Trust Online Community system will signify your acceptance of any change in the Privacy Policy now or in the future.

6. Content of Messages

You alone are responsible for the content of your messages and the consequences of any such messages. The Woodland Trust Online Community reserves the right to restrict, suspend or terminate your registration if it becomes aware and determines, in its sole discretion, that you are violating any of the following guidelines:

i. You may not use the Woodland Trust Online Community via the Woodland Trust Online Community system or any subscriber's information, personal or otherwise, for any commercial purpose or to obtain direct financial gain (e.g. mass marketing). The Woodland Trust Online Community is to be used by you for your personal use only. Commercial uses of the Woodland Trust Online Community are strictly prohibited unless prior written consent from Woodland Trust Online Community has been granted for such use.

ii. The Woodland Trust Online Community via the Woodland Trust Online Community system must not be used for chain letters, junk mail, 'spamming', solicitations (commercial or non-commercial) or bulk communications of any kind (including but not limited to sending messages to distribution lists) unless the recipient has given specific permission to be included in such a list.

iii. The Woodland Trust Online Community via the Woodland Trust Online Community system must not be used to send or distribute any message or material that is unlawful, harassing, libellous, defamatory, abusive, threatening, harmful, vulgar, obscene, profane, sexually oriented, threatening, racially offensive, inaccurate or which otherwise includes objectionable material of any kind or nature (including but not limited to, illegal material in the form of text, graphics, video, programs or audio) or that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable local, national or international law or regulation. No such message or material must be distributed or sent via Woodland Trust Online Community system or posted on message boards or placed on the Woodland Trust Online Community system. The Woodland Trust Online Community reserves the right to delete at its sole discretion any such material from the Woodland Trust Online Community system.

iv. You must not impersonate any other person or entity, whether actual or fictitious.

v. You must not use an inappropriate nickname of any kind.

vi. You may not post content or participate in any form of discussion with the intention to commit any illegal activity.

vii. You must not use the Woodland Trust Online Community via the Woodland Trust Online Community system or any part of it in a way that might reasonably be expected to cause the same to be interrupted, damaged, and rendered less efficient or which could in any way damage the operation of another's computer.

7. Intellectual Property

You acknowledge that (i) the Woodland Trust Online Community permits access to content that is protected by copyrights, trademarks and other intellectual and proprietary rights ("Rights"); (ii) these Rights are valid and protected in all media and technologies existing now or later developed; and (iii) except as explicitly provided otherwise, these Terms of Service and applicable copyright, trademark and other laws govern your use of such Rights. You may not post to the Woodland Trust Online Community via the Woodland Trust Online Community system, copy, reproduce, retransmit, distribute, publish, commercially exploit or otherwise transfer any material subject to any Rights. The burden of determining that any information, software, images or any other content on the Woodland Trust Online Community system is not protected by Rights rests with you. You acknowledge that you will not acquire any Rights by downloading any materials on the Woodland Trust Online Community system.

By submitting content, which shall include your user nickname, to any ‘public area’ of the Woodland Trust Online Community via the Woodland Trust Online Community system, including message boards, forums, and chat rooms, you grant the Woodland Trust Online Community and its affiliates a royalty-free, perpetual, irrevocable, non-exclusive right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, communicate to the public, perform and display the content (in whole or in part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, for the full term of any Rights that may exist in such content.

You also warrant that the holder of any Rights, including moral rights, in such content (whether this is you or a third party) has completely and effectively waived all such rights and validly and irrevocably granted to you the right to grant the licence stated above. You also permit any user to access, display, view, store and reproduce such content for personal use. Subject to the foregoing, the owner of such content placed on the Woodland Trust Online Community system retains any and all Rights that may exist in such content.

8. Downtime and Modifications of the Site

The Woodland Trust Online Community system shall be available to you at any times, where the Woodland Trust Online Community is not available due to downtime of the Woodland Trust Online Community system, as a result of any service interruption whatsoever all reasonable steps will be taken at the sole discretion of the Woodland Trust Online Community to provide, restore or remedy the downtime of the Woodland Trust Online Community system. The Woodland Trust Online Community will not be liable to you for any indirect or consequential loss that you may suffer even if the loss is reasonably foreseeable or the Woodland Trust Online Community has been advised of the possibility of you incurring it.

The Woodland Trust (Charity) may modify or discontinue the Woodland Trust Online Community system with or without notice to you and without liability to you or any third party.

9. Termination

The Woodland Trust Online Community reserves the right, at its sole discretion, immediately, without notice to you to restrict, suspend or terminate (i) these Terms of Service; (ii) your registration with or ability to access the Woodland Trust Online Community system and/or any other service provided to you by the Woodland Trust Online Community or the Woodland Trust Online Community system (including any e-mail and web page services) upon any breach, or suspected breach by you of the Terms of Service (as determined in Woodland Trust Online Community's sole discretion). The restriction, suspension or termination of our service pursuant to this section will be without prejudice to any rights, which the Woodland Trust Online Community may have against you in respect of your breach of these Terms of Service.

10. Disclaimer of Warranties

The Woodland Trust Online Community system is provided on an "as is" and "as available" basis. The Woodland Trust (Charity) expressly disclaims all warranties or representations of any kind, express or implied, to the fullest extent permitted by law.

You understand and agree that the Woodland Trust (Charity) does not guarantee the accuracy or completeness of any information in or provided in connection with the Woodland Trust Online Community. The Woodland Trust (Charity) is not responsible for any errors or omissions or for the results obtained from the use of such information. The information is provided with the understanding that neither the Woodland Trust (Charity), its employees or consultants or its users, while such users are participating in Woodland Trust Online Community, are engaged in rendering legal, medical, counselling or other professional services or advice. The Woodland Trust (Charity) encourages you to seek appropriate professional advice or care for any situation or problem, which you may have.

The Woodland Trust (Charity) shall not be responsible for any loss or damage caused, or alleged to have been caused, directly or indirectly, by the information or ideas contained, suggested or referenced on Woodland Trust Online Community via the Woodland Trust Online Community system. Your participation in Woodland Trust Online Community is solely at your own risk. No advice or information, whether oral or written, obtained by you from the Woodland Trust Online Community or through Woodland Trust Online Community shall create any warranty not expressly made in these terms of service or imposed by law.

11. Limitation of Liability

To the fullest extent permitted by law the Woodland Trust (Charity) shall not be liable for any direct, indirect, incidental, special or consequential damages, resulting from the use or the inability to use Woodland Trust Online Community via the Woodland Trust Online Community system or messages received or transactions entered into through Woodland Trust Online Community system or resulting from unauthorised access to or alteration of your transmissions or data even if the Woodland Trust Online Community has been advised of the possibility of such damages.

12. Remedies for breach of these Terms by you

In the event that the Woodland Trust Online Community determines, at its sole discretion, that you have breached any portion of these Terms of Service, or have otherwise demonstrated conduct inappropriate to the Woodland Trust Online Community, the Woodland Trust Online Community reserves the right to (i) warn you via e-mail that you have violated these Terms of Service; (ii) delete any content provided by you or your agent(s) to the Woodland Trust Online Community system, (iii) discontinue your registration with Woodland Trust Online Community via the Woodland Trust Online Community system (iv) notify and/or send content to and/or fully cooperate with the proper law enforcement authorities and/or agencies for further action; and/or (v) take any other action which the Woodland Trust or the Woodland Trust Online Community deems to be appropriate.

13. Indemnification

You agree to indemnify and hold each of the Woodland Trust Online Community, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your use of the Woodland Trust Online Community via the Woodland Trust Online Community system, the violation of these Terms of Service by you, or the infringement by you, or any other subscriber of your account, or of any intellectual property or other right of any other person or entity.

14. Applicable Law

These Terms of Service shall be governed by and construed in accordance with the laws of England.
